INTRODUCTIONThis Privacy Notice sets out how the Ports of Jersey Ltd (POJL) deals with your personal data. 

We are committed to protecting your privacy and takes the way it handles your personal information very seriously. We are registered as a data controller under the Data Protection Law. Any personal information collected by POJL is handled in accordance with applicable data protection legislation. 

We take privacy and security of your information seriously and will only use such personal information as set out in this privacy policy 
CONTROLLERInformation which is collected will be the responsibility of the Ports of Jersey Ltd who will act as data controller in relation to personal data across all the functions of Ports of Jersey including Harbours, Airport, Coast Guard, Marinas, Ship Registry and Aircraft Registry.

WHAT DATA WE COLLECTWhen visiting our website we collect basic contact information about you for the purpose of telling you about Ports of Jersey 

Ports of Jersey hold data relating to . 

1. Staff: for employment, safety and security 
2. Suppliers: for contracts, services, billing 
3. Drone Operators: for licencing/ registration, billing 
4. Plane Owners: for plane registration, hangars, billing 
5. Boat Owners: for boat registration, marinas, moorings, billing including liaison with Visit Jersey and other hospitality related organisations 
6. Parking: for safety, security and billing 
7. Tenants: in relation to property management, leases and billing 
8. Passengers: in relation to travel, safety, security including liaison with Airlines, Shipping and Ferry Operators, G4S, Police and Customs 

This is all detailed in the following sections or relevant contracts, agreements, terms and conditions relevant to the product, service or functions.
WHERE AND WHEN WE COLLECT YOUR DATAGiven the broad range of services that we provide we collect data through a wide variety of ways.

Substantially we collect data as part of a contractual process, for example employment contracts, supplier contract, business partner contracts, mooring, tenant contracts. In all cases these contracts set-out the specific data being gathered, the purpose, and safeguards including data-protection, information security, retention period and rights.

In some cases where a contract is not appropriate (e.g. in relation to necessary CCTV Surveillance at the Harbour and Airport for security, safety and regulatory purposes) we gather limited data necessary as part of our statutory function(s).

In some cases relationships are not contractual but it remains important to set-out the specific data being gathered, the purpose, and safeguards this incudes services such as subscriptions for memberships or mailing lists (for example to receive quarterly newsletters from Ports of Jersey.

Inevitably it is impossible to detail every element of each service and the related data in this Summary Privacy Notice. Please therefore refer to the contract, agreement, subscription form, brochure relevant to the product or service.

WHAT PURPOSES USE YOUR PERSONAL DATA FORWe use your data to provide the services meeting your needs. in some cases these will be contractual or subscription services, I others they may be statutory functions relating to the open, safe and secure operation of Jersey Airport, Harbours and Coast-Guard.

Inevitably it is impossible to detail every element of each service and the related data in this Summary Privacy Notice. Please therefore refer to the contract, agreement, subscription form, brochure relevant to the product or service.

STATUTORY OR CONTRACTUAL REQUIREMENTSIn some cases data we hold and process is necessary for the services we provide, for example 

> we cannot provide contractual services without having the details of the contracting party ,

In some cases the data we hold is optional and based on your consent which you may withdraw at ant time. For example you may un-subscribe to memberships or mailing lists.

HOW LONG WE HOLD DATAPorts of Jersey will retain your personal data for as long as necessary to fulfil the purpose for which it was collected. 

Where acting as a Public Authority we hold records in accordance with Public Records Law and (where relevant) as part of Freedom of Information. 

We maintain a Records Retention Policy which is publicly available. 
DATA SECURITYPorts of Jersey uses up-to-date data storage and security techniques to protect your personal information from unauthorised access, improper use or disclosure, unauthorised modification or unlawful destruction or accidental loss.

We have a Data Protection Policy and Information Security Policy and Training Policy ensuring high standards of governance for your data.
DATA SHARING AND DISCLOSUREWe do not share or your data beyond what is agreed as necessary for the provision or operation of our services to you. This is clearly explained in your Contract or Agreement.

There are circumstances where we share anonymised data (not identifying you) with tourist and hospitality organisations. For example details of passenger numbers by boat or by plane, details of arrivals from the UK or Europe.

There are legal and regulatory circumstances where we are obliged to share data, for example with Police, Customs & Excise and other similar bodies for the open, safe and secure operation of Jersey Airport, Harbours and Coast-Guard.
THIRD COUNTRY TRANSFERS AND SAFEGUARDSPorts of Jersey operate in Jersey and our data substantially resides in Jersey.

However we do use technology which may transfer data to another jurisdiction, for example use of Microsoft and Cloud-based back-up of data.

Where such transfers do not offer the same level of protection of personal data as may be enjoyed within your home country (e.g. United States) we will ensure that your data is appropriately protected (for example by reference to IT security standards)
YOUR RIGHTSYou have the right to apply for a copy of the personal data we hold about you and to have any inaccurate personal data about you rectified.

In some circumstances you may also have the right to ask us to erase your personal data or restrict its processing. 

Where we process your data for our legitimate interests, you have the right to object to such processing.

CCTV

WHAT DATA WE COLLECTOur CCTV is used to capture and monitor images of events that take place in specific locations in real time. The images may also be recorded on a computer hard drive or magnetic tape depending on the type of camera. Cameras may be focussed on a fixed location, set to scan a particular area, or they can be operated remotely by specially trained operators.
The cameras used to enforce our Safety (eg at Passenger Terminals) and Charging schemes (eg Parking) are ANPR cameras which capture number plate data in the form of text rather than images. A still photographic image is also captured for evidential purposes if a Penalty Charge is issued.
WHAT PURPOSES USE YOUR PERSONAL DATA FORWe use this data for CCTV services and related functions and for no other purpose without your prior agreement
LAWFUL BASISUnder data protection legislation, we are only allowed to use personal information if we have a proper reason or 'legal basis' to do so. In the case of surveillance cameras, we operate them to perform tasks in support of our statutory functions - which are to deliver 'safe, integrated, efficient and economic transport facilities and services to, from and within Jersey.
We operate surveillance cameras for six main purposes:
Protecting the health and safety of employees, customers and members of the public
The management and investigation of major incidents
Preventing and detecting crime and antisocial behaviour
Realtime traffic monitoring
Enforcing traffic rules and regulations (eg parking) 
Supporting the efficient management and operation of our road and networks
DATA SHARING AND DISCLOSUREWe have contracts with a number of third party service providers, which provide maintenance services and ensure the efficient day-to-day operation of our surveillance camera systems. We also use external service providers to download images when we have a business need to retain them for longer than the default retention period.

On a case by case basis we may use and share CCTV images for research and analysis purposes. For example these may be used to improve the management of health and safety incidents, or travel demand management.

Some surveillance camera infrastructure is shared with third parties such as the police and local authorities. In certain agreed circumstances, they may take control of a limited number of cameras and use them for activities such as the prevention and detection of crime and anti social behaviour, policing major events and crowd control. These arrangements are covered by information sharing agreements and we are not responsible for the camera when it is in the control of the third party.

In some circumstances, other disclosures of personal data (including CCTV images) to the police and other law enforcement agencies are permitted by data protection legislation, if they relate to the prevention or detection of crime and/or the apprehension or prosecution of offenders. Before any such disclosure takes place, the police are required to demonstrate that the personal data concerned will assist them in this respect. Each police request is dealt with on a strictly case-by-case basis to ensure that any such disclosure is lawful.
YOUR RIGHTSWe also voluntarily comply with the 12 principles set out in the Surveillance Camera Code of Practice issued by the Home Office (which applies to local authorities and police forces in England and Wales). It states that organisations which use surveillance camera systems must:

use them for a specified purpose in pursuit of a legitimate aim
take into account their effect on individuals and their privacy
be as transparent as possible about how they use them
have clear responsibility and accountability arrangements for all surveillance activities
have clear rules, policies and procedures in place
have no more images and information stored than is strictly necessary
restrict access to retained images and information
work to meet and maintain relevant operational, technical and competency standards
have in place appropriate security measures to safeguard against unauthorised access and use
have effective review and audit mechanisms
use them in the most effective way to support public safety and law enforcement
keep associated data accurate and up to date
